This agreement applies to all services provided by DaMarcus Morton, operating under the brand MINDSET FOR RECOVERY, which includes personalized coaching, courses, and the Cortex AI application (the "App"). By registering for, accessing, or participating in any service, you agree to the following:

1. Services Provided (Hybrid Model & Scope)

All services—whether individual coaching, group sessions, workshops, courses, or the use of the Cortex application—are considered Coaching under this agreement.

Role: Your coach is a mentor, teacher, and accountability partner who supports your mindset and recovery journey. The Cortex app is an automated extension of this coaching methodology, providing personalized guidance and support.

Disclaimer: Coaching is not therapy. DaMarcus Morton is not a licensed therapist or medical professional and does not diagnose, treat, or manage clinical mental health conditions or substance use disorders.

2. Participant Responsibilities

Coaching and App usage require full participation. Results are not guaranteed. You are responsible for being honest, completing assignments, and actively engaging with the coaching process and the App's tools.

3. Sessions, Scheduling & Fees

Billing Options: Upfront/Monthly Investment as specified at checkout.

Cancellations: No refunds for missed sessions. If DaMarcus Morton cancels a session, it may be rescheduled or a credit will be provided.

Refund Policy: All payments, including payment plans and subscription fees, are non-refundable unless otherwise stated in writing.

4. Confidentiality & Data Security

A. Distinction Between Privacy and Professional Confidentiality

Initial Private Communication: All preliminary inquiries, including those initiated via the "Chat Privately" feature, are treated as Private. This denotes a one-on-one, direct communication channel between the User and the Coach. However, the User acknowledges that the technical security of these initial messages (including SMS, unencrypted cellular data, or physical access to the User’s device) is the responsibility of the User. The Coach is not liable for privacy breaches occurring on the User's hardware or through third-party mobile carriers.

Professional Confidentiality: Upon formal enrollment and execution of a coaching service agreement, the relationship transitions to a Confidential status. Professional Confidentiality covers all session content, personal data, and strategic materials shared within the scope of the coaching engagement.

B. AI Data Security & Cortex (Delphi AI Platform)

Encryption Standards: All conversational data within the Cortex App is protected by industry-standard AES-256 encryption for data at rest. The underlying platform (Delphi AI) maintains SOC 2 Type 2 compliance, ensuring rigorous independent auditing of security controls.

Data Usage: Your data is used only to deliver and personalize your coaching experience within the App and is not sold to third parties. Data may be aggregated and anonymized for internal product improvement.

AI vs. Human Disclosure: You acknowledge that while the App maintains strict confidentiality standards, interaction with the AI is not privileged communication like that with a licensed therapist.

C. California Privacy Disclosures (CalOPPA/CCPA)

Right to Delete: Users have the right to request the deletion of their personal data. To exercise this right, please email [Your Support Email] with the subject "Data Deletion Request."

Do Not Track: This website and App do not currently respond to "Do Not Track" (DNT) signals from web browsers.

5. Intellectual Property

All coaching materials, content, and the Cortex application interface/methodology are owned by DaMarcus Morton. You may not reproduce, distribute, or reverse-engineer any content or the App without written permission.

6. False Claims & Reputation

If a participant makes public, harmful, and false statements regarding the Coach or MINDSET FOR RECOVERY, DaMarcus Morton reserves the right to respond publicly to the extent necessary to protect his professional reputation.

7. Liability Waiver

You agree to hold DaMarcus Morton, staff, and guest coaches harmless for decisions, actions, or results that occur during or after coaching or through the use of the Cortex app. Coaching and the App provide tools for growth, not guarantees of specific outcomes.

8. Legal Jurisdiction

This agreement is governed by the laws of the State of California. Any disputes arising from this agreement will be resolved through binding arbitration in Los Angeles, California, rather than in a court of law.
